Overtime Labor Laws

On the word of Indian labor law, an employee should be scheduled to work only for 8hrs a day with one hour break. The same has been revised in many organizations and optimized to 10 hours a day. Over and above the given time frame, a person can be allowed to work up to 12 hours. The working hours beyond the restricted time frame put into effect by Indian labor law should be calculated as overtime and the worker should be paid overtime allowance for every hour.

How many companies go along with this overtime labor laws?

There are many people working more than twelve hours a day without any remuneration. Even knowing the Indian labor standards, they are forced to run the errand. If they fall short they will be incapacitated.

Employee warning letter or termination of contract letter

Many organizations that overrule these Indian labor laws always have an “Employee warning letter” or a “termination of contract letter” ready made and dominate the employees with backing of another line of players called as “trainees”. A fresh graduate with no experience who does the same job of a regular member of staff is titled as a trainee. The trainee will be saturated with one third of a regular employee’s salary called as stipend.

Taking this as paranoid the confirmed member of staff has to comply with the overruled office timings. Their understanding is that if they fail to comply with these odds their position will be replaced by a trainee. In simple terms they are alarmed about losing their job.

Just think of a person coming to office from a long distance. The traveling time may be 1 hour and the person works for 12 hours and will be pried bringing his liberty to a constraint. Again spends 1 hour in travel. 14hrs gone in a day’s life, imagine if the person uses the office cab facility. Additional 1 hour had gone waiting for the cab and 360 degree journey. With the remaining 9 hours the worn out person will do what?

With all this mental agony the employee will continue with the work to avoid being abrogated.

Beyond all these gripes, they are even forced by the shameless company to attend some events like booze party called as team outing which should be purely optional especially for women. At least that day could be a probability for them to spend some time with their family.

Even their participation in team outing is taken in consideration during their appraisal. Almost 80% of the employees are not satisfied with the evaluation. In some companies the evaluator reports are biased and there are some workers getting an employee warning letter instead of a salary hike.

Anticipating trainees

Trainees do the same job of a regular employee for a minimal stipend. They work hard to become a confirmed employee of the organization. They even work overtime (in the current scenario overtime is working more than 12 hours) for their confirmation. They do not know the overtime labor laws and they will not care about it in the early stages. During their appraisal they will realize that all these days their organization was playing a shell game with them.

In most of the cases their training period will be extended or they will be presented a termination of contract letter. There are some organizations where they ask the trainees to pay a huge amount for the training, to get their confirmation.

The trainee and employee know that they are in the captivity, but they do not know where to complain. There is no use of discussing it within their team as they are on the same page. They do not know how to fight against this glitch and they do not know who will listen to their grievances.

Points to ponder: Are you aware that these selfish organizations can control only their employees? Understand that there are many people lost something that you have.
